Introductory Provisions
The following document contains the legal terms relating to shopping in Internet stores operated by ProtoLAB Kft. By approving your order you accept the contract below in accordance with the legal provision relating to concluding contracts between parties not present, so please make sure that you read it carefully before finalising your order!
This is ProtoLAB Kft.'s Internet store. If you decide to use the services of this site and send your order on our company's website, at the same time you declare that you know and accept the General Terms of Contract (hereinafter: GTC) concluded between you and ProtoLAB Kft. in the form of an agreement and recognise these terms as obligatory with respect to yourself. ProtoLAB Kft. maintains the right to modify the GTC without any further agreement or notification, and it is the responsibility of the user of the website to check the currently valid GTC in each case.
Only persons above the age of 18 may make purchases and submit orders in the web shop. By submitting an order a purchase agreement is concluded in accordance with the terms prescribed herein, between ProtoLAB Kft. and the private person or company submitting the order (hereinafter; customer), and Customer undertakes the obligation to take receipt of the goods ordered and settle the purchase price at the same time.
Identification of Contracting Parties
The purchase agreement is concluded between ProtoLAB Kft. as Seller and Customer as Buyer. In order for your order to be accepted you need to supply your or your company's data as required on the order form pages of the web site. Deficient, false or inaccurate data is not accepted and such orders are rejected. If the registered data is not in compliance with reality or is against any of the provisions of the GTC, the order is cancelled without giving reasons. ProtoLAB Kft. maintains the right to check the correctness of the registered data. We maintain the right to abandon the fulfilment of the order, without giving reasons, at any time before the purchase price is settled.
Our special trade products (LyL Special Trade Cosmetic Products) may only be ordered by registered and qualified beauticians and masseurs. If you are not yet registered at ProtoLab Kft., please send us your beautician or masseur certificate (fax number: +36 23 362 890) when you submit your first order. Obviously it only stands for our beautician and masseur customers.
We always conclude individual contracts with our resellers.
Goods can be ordered for a minimum value of HUF 5,000.
Home Delivery
In each case delivery takes place by post, with payment by cash on delivery.
Payment
The final amount determined exactly in advance shall be paid to the courier or postal delivery service when taking receipt of the goods.
The courier or postal delivery worker shall hand over the invoice issued on the goods and the transportation costs to Customer together with the goods.
Prices
The price stated on the data sheet of the products is the recommended net price of the product + VAT. The recommended price is valid in the given moment, and it becomes a final price only after Customer has performed the steps of the ordering process in accordance with the rules and approves of the order. ProtoLab Kft. shall inform Customers by telephone or in e-mail on price changes taking place in the period between making the order and performing delivery. In such cases Customers are not obliged to accept price changes, and they may abandon their purchasing intention.
If certain orders are modified or combined for any reason, the terms of delivery and payment valid at the time of making such modifications shall govern with respect to modified orders. ProtoLab Kft. maintains the right to change prices without giving reasons.
Seller's Responsibility
ProtoLab Kft. does not undertake responsibility for clerical errors, the correctness and reality of the information disclosed on the site. With respect to Users ProtoLab Kft. maintains the right to delete or suspend the service and the content for any reason, without previous notification, and also to make any change or to terminate the service or content completely or partially. ProtoLab Kft. does not undertake responsibility, either with respect to visitors or users, for any damage deriving from suspension or total termination or change relating to the whole or a part of the content, realised without further notification.
Customer's Responsibility
Customer understands that by approving its order(s) it accepts the present contract, and any failure to observe the provisions prescribed herein shall be regarded as a breach of contract for which Customer shall bear legal responsibility.
Customer undertakes to take receipt of and pay for the items containing the goods ordered in the orders approved by it, in accordance with the methods of payment described in the GTC. In the case of a failure to deliver the item due to Customer's fault, all extra costs deriving from it shall be paid by Customer to ProtoLab Kft. In such cases ProtoLab Kft. shall issue an invoice on the amount of the extra costs.
Scope of Contract
The present contract enters into force when the order is approved, and it is accomplished when the order is fulfilled. In the case of permanent orders the contract shall remain in force until all claims of the parties asserted with respect to each other have been fulfilled.
Copyright
Without the permission of ProtoLab Kft. it is prohibited to use the name, picture, logo for any product or service that does not belong to ProtoLab and is suitable for confusing customers or destroying the good reputation of ProtoLab Kft. or its Internet stores. The worded information, pictures, emblems, typographical and design elements on our Internet site are under copyright protection, their reproduction, distribution or use without ProtoLab Kft.'s written permission is prohibited.
Closing Provisions
In respect of questions not regulated in the present contract and the relating documents, the Civil Code and the legal provisions relating to electronic trade and concluding contracts between parties not present shall govern.
In the case of any legal disputes the court with jurisdiction according to the headquarters of ProtoLab Kft. (as operator) shall be regarded as competent.
